The petitioner is languishing in custody for the offence under Sections 147,148,149,307,353,120B & 323 of the Indian Penal Code & Sections 25(1-b)A, 26, 27, 35 of the Arms Act & Section 30(A), 38 &41 of the Bihar Prohibition & Excise (Amendment) Act, 2016.

Submission is that only material against the petitioner is confessional statement of co-accused. Nothing has been recovered from possession of the petitioner neither fire-arm nor liquor was recovered from his possession. Petitioner is in custody since 29.06.2019.

Considering the facts of this case and criminal antecedent of the petitioner, let the petitioner, above named, be released on

Patna High Court CR. MISC. No. 48266 of 2019(2) dt.06-08-2019 2/2 bail after completion of investigation, on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Special Excise Case No. 3438 of 2019, arising out of Barh P.S. Case No. 163 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court below having immovable property in his name.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) khushbu/- U T
