JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 19.05.2015 passed in Cr. Misc. No. 4465 of 2015, directing the trial court to conclude the trial of the petitioner within nine months but the impugned order goes to show that charge against the petitioner could be framed on 01.07.2016 and up till now, not a single prosecution witness could be examined.

Petitioner is in jail custody for more than two years and it appears that after framing of charge against the petitioner, there is no substantive progress in trial of the petitioner, Considering the aforesaid facts and circumstances as

No.41541 of 2016 (2) dt.05-10-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Samastipur in connection with Session trial no. 41 of 2015 arising out of Hasanpur P.S.Case No. 27 of 2014.
