JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-10-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 13.11.2017 passed in Cr.Misc.No. 50568 of 2017 and allegation against him is of recovery of 23 kg. of ganja from the tempo and petitioner was arrested from the tempo.
Submission of learned counsel for the petitioner is that nothing has been recovered from his conscious possession, rather from the tempo and 9 kg. ganja has been recovered from conscious possession of Sanik Kumar @ Sanni, who has been granted bail by a co-ordinate Bench of this Court vide order dated 18.9.2018 passed in Cr.Misc.No. 40291 of 2018 and petitioner is in custody since 10.7.2017, having no criminal antecedent. Heard learned APP also.

No.62497 of 2018 (2) dt.10-10-2018 2/2 Having heard both sides and in the facts and circumstances and also considering the period of custody, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Bhagalpur, in connection with Gopalpur (Rangra) P.S.Case No. 154 of 2017, subject to the condition that one of the bailors shall be a family member of the petitioner having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner has to co-operate in disposal of trial and appear in court as and when required, otherwise his bail bond shall be cancelled.
