2. The petitioner apprehends his arrest in a case registered for the offence under Section 103(1)/61(2)(a)/3(5) of the BNS and Section 27 of the Arms Act.
3. As per the prosecution case, when the informant's husband was returning home after participating in the last rituals of the father of Ashok Singh, the co-accused persons along with 5-7 unknown miscreants holding weapons fired indiscriminately upon the informant's husband and one Chandan Kumar due to which they died. On hearing the noise of firing, the informant, her brother along with villagers ran towards the spot and saw them firing while fleeing away.
4. Learned counsel for the petitioner submitted that the petitioner is innocent and has falsely been implicated in this

The name of the petitioner has surfaced during the course of investigation of the basis of confessional statement of co-accused Rama Kant Singh who has already been granted by bail by a co-ordinate Bench of this Court vide order dated 10.09.2025 passed in Cr. Misc. No. 59934 of 2025. Petitioner is the owner of Mahadeo Cinema Hall. It is alleged that on the instruction of this petitioner, coaccused Rama Kant Singh arranged the accommodation of four persons in the Cinema Hall and it is further submitted that there is no allegation that this petitioner participated in the alleged occurrence. As a matter of fact, the petitioner was not present at the place of occurrence.
He further submits that for the same occurrence, two informations were given in one information which is the basis of Pipariya P.S. Case no. 60/2025 lodged by the wife of the deceased and six persons were named with their detail address but there is no whisper about any complicity/role of the petitioner. In the second information, given by the brother of another deceased namely Chandan which is mentioned in the case diary (Station diary) informant has specifically and categorically alleged that 6-7 unknown persons have committed the murder of his brother. F.I.R. has been lodged after a delay of one day.

5. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts & circumstances of the case and also the fact the petitioner claims clean antecedent, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Pipariya P.S. Case No. 60/2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ Section 482(2) of BNSS, 2023.
