Petitioners seek bail in G.B. Nagar P.S. Case No.372 of 2017 instituted for the offence under Section(s) 272, 273, 308 Indian Penal Code and Sections 30, 34, 36, 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioners submits that petitioners were not apprehended on the spot.

In the written report, it is alleged that two persons, namely, Anil Kumar and Sudarshan Prasad, were apprehended on the spot. They disclosed the name of the petitioners. In the seizure list, it is alleged that illicit liquor has been recovered from the land of Tuntun Singh adjacent to bank

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan, in connection with G.B. Nagar P.S. Case No.372 of 2017, subject to the condition that both the bailors shall be close relative of the petitioners.
