Initially, case was registered under section 307 and other minor sections of the Indian Penal Code but in course of investigation, injured died and accordingly, section 302 of the Indian Penal Code was added.

No doubt, petitioner is named in the first information report but no specific overt-act has been attributed against him. There appears to be land dispute between the parties and investigation against the petitioner has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in Kumarkhand P.S.
