The petitioner seeks bail in Nautan P.S. Case No.373 of 2018 registered under Sections 380, 414 of the Indian Penal Code.
The informant alleged that his motorcycle bearing registration no.BR-22AA-1536 was stolen from his garage. The informant suspected that the petitioner and four others might have committed theft of his motorcycle.
The learned counsel for the petitioner submits that the informant and other villagers apprehended the petitioner and one Md. Hafiz. They also recovered two motorcycles from the house of Bhola Singh. The villagers produced the petitioner and motorcycle before the police but the stolen motorcycle was not
Patna High Court Cr.Misc. No.61495 of 2018 (2) dt.06-10-2018 recovered. It is submitted that petitioner has got no manner of concern with the recovered motorcycle from the house of Bhola Singh. Petitioner is in jail since 15.07.2018. Considering the facts aforesaid and the fact that petitioner is in jail for about three months, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Nautan P.S. Case No.373 of 2018.
