JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,379,323,307 and 504/34 of the Indian Penal Code. It is alleged that the accused persons assaulted the informant by lathi and iron rod. Specific accusation of assault is against co accused Birbal Sahani whereas it is alleged that petitioner no. 2 Thag Chauhan snatched silver chain from the neck of the informant.

It is submitted by the learned counsel for the petitioners that only one sharp cut injury on the scalp of the informant simple in nature has been found which is alleged to have been caused by

Patna High Court Cr.Misc. No.31271 of 2015 (2) dt.31-07-2015 2/2 co accused Birbal Sahani. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the accusation being not specific against the petitioners, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Gopalganj, in connection with Bishambharpur P.S. Case No.81 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
