JUSTICE RAKESH KUMAR ORAL ORDER 23-12-2016 Heard Sri Sanjeev Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody in O.C. Case no.1/2016 registered for the offence under Section 20 of the N.D.P.S. Act, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that the petitioner is a vegetable vendor and it was alleged that the petitioner was possessing Ganja weighing about 20 Grams. By way of referring to the statement made in paragraph-3 of the petition, it has been argued that the petitioner is having clean antecedent.
Considering the lesser quantity of recovered Ganja and clean antecedent of the petitioner, let the petitioner, namely,
Patna High Court Cr.Misc. No.50496 of 2016 (2) dt.23-12-2016 2/2 Bharat Sah be released on bail on furnishing bail bond of Rs.10,000/-( Ten thousand ) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, West Champaran at Bettiah in connection with O.C.
