2. The petitioners have preferred this application for grant of regular bail in connection with Rampur P.S. Case No. 265/2025 dated 30.05.2025 registered for the offences punishable u/s 191 (2), 191 (3), 190, 126 (2), 115 (2), 352, 351(2)(3), 109(1), 308 (4) of B.N.S. and Section 37 of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, on 30.05.2025 at about 06:30 PM, the informant was going to mosque to offer namaz. It is further alleged that when he left the house, around 8-10 boys, dragged him to the left side of the house and started

Patna High Court CR. MISC. No.50516 of 2025(2) dt.29-07-2025 2/3 abusing. One of them, Sufiyan put pistol on his head and demanded extortion money of Rs. 25,000/-. On objection, all accused persons started assaulting him. When the informant's father came to rescue him, they assaulted him with deadly weapons due to which he sustained head injuries. It is further alleged that the co-accused Sufiyan fired with an intent to kill but the bullet missed. When police arrived there, all the accused persons started running away but on chase the petitioners were apprehended and they were found in intoxicant condition.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from the possession of the petitioners. There is general and omnibus allegation against the petitioners. The petitioners have no concern with the alleged occurrence. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 31.05.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing

Patna High Court CR. MISC. No.50516 of 2025(2) dt.29-07-2025 3/3 bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Gaya in connection with Rampur P.S. Case No. 265/2025.

7. The application stands allowed.
