The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 326, 307, 379, 504, 506/34 of the Indian Penal Code. The prosecution story is that the petitioner along with other co-accused persons went at informant's land of wheat crop and harvesting the same. In the meantime, informant with his family members went at the place of occurrence and protested them thereafter they started assaulting as a result of which informant and his brother sustained injury.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. There is land dispute between the petitioner and informant going on due

Patna High Court CR. MISC. No.52277 of 2022(3) dt.12-01-2023 2/2 to which he has falsely been implicated in this case. A statement has been made in para-3 of the petitioner that the petitioner has got no criminal antecedent. There is no repetition of blow. It is further submitted that the petitioner is languishing in judicial custody since 9.6.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Matiyaria P.S. Case No. 36 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah.
