The petitioner seeks bail in Khizersarai P.S. Case No.218 of 2018 registered for the offence under Sections 295, 295(A), 379,411 of the I.P.C. and Section 37(B) of Bihar Prohibition Excise Act.

Accusation is that in the evening of 14.08.2018 on receipt of information that one person of Goraiya Sthan in drunken state had uprooted a stone Idol of Goraiya Baba in villageNaudiha effecting the sentiment of certain community the informant being an A.S.I. of Police Station reached the place of occurrence and found a person having drunken state in a possession of an stone idol of Goraiya Baba and on query he disclosed his name as Sujit Paswan.

Patna High Court Cr.Misc. No.62370 of 2018 (2) dt.06-10-2018 2/2 Submission on behalf of the petitioner is that the petitioner is in custody since 16.08.2018 having no criminal antecedent.

Heard the learned A.P.P. also who opposed the prayer for bail of the petitioners.

Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Gaya, in Khizersarai P.S. Case No.218/18.
