2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 379 of the Indian Penal Code.

3. As per prosecution case, F.I.R. was registered against unknown for theft of tractor of informant.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner transpired on the basis of confessional statement of co-accused. No stolen article has been recovered from possession of the petitioner.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation, this

No.56362 of 2024(2) dt.09-09-2024 2/2 anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Masaudhi in connection with Masaudhi P. S. Case No. 387 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
