1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 76, 303(2), 351(2), 352, 3(5) B.N.S.S.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on 23.03.2025 at about 2:30 P.M., all the accused

No.51849 of 2025(3) dt.17-09-2025 2/3 persons blocked the road by building a structure by bricks and cement in front of informant's house, on objection, the accused persons abused and assaulted by using sticks, iron rods causing head injury to the informant. It is next alleged that when the family members of the informant tried to intervene, they were also assaulted by the accused persons, further, Sanjay Mukhiya and petitioner no.2 assaulted Urmila Devi and Duro Devi by pulling their hair and even tore their clothes and snatched silver chain and golden nose-pin. Thereafter, petitioner no.3 and Navin threatened the informant and his family members. Later, with the help of villagers, injured persons were taken to hospital for treatment.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant and petitioners and informant are agnates, as has been pleaded at para-8 of the anticipatory bail application and are fishermen. Further, on account of dispute relating to land, the occurrence is alleged to have taken place in which both sides assaulted each other and the injuries suffered by the injured have been opined to be simple in nature as pleaded at para-11 of the anticipatory bail application.
5. Learned A.P.P. for the State opposes the anticipatory

6. Considering the submissions made on behalf of the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sarai Bhaptiyahi P.S. Case No. 80 of 2025, subject to the conditions as laid down under Section 482
(2) of BNSS.
7. Accordingly, the instant anticipatory bail application stands allowed.
