The petitioner seeks bail in Gopalpur P.S. Case No. 184 of 2020, registered for the offence punishable under Sections 406, 420, 379 of the Indian Penal Code. As per the FIR, driver of the informant disappeared his tractor loaded with sand under a conspiracy with a view to sell the same.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. Name of petitioner transpired in this case on the basis of confessional statement of co-accused Jahangir Alam. Looted tractor was recovered from abandoned place. Petitioner is in custody since 21.01.2021. Investigation is complete.

Considering the facts and circumstances of the case the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two
