02. 17.10.2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 447 and 504/34 of the Indian Penal Code.

It is contended on behalf of the petitioner that it is a case of misuse of privilege of bail. It is further contended that the offences are bailable and, thus, the petitioner was on bail, however, due to some unavoidable circumstances he could not appear and his bail bonds were cancelled on 25.03.2016. No.42849 of 2016 (2) dt.17-10-2016 case, the petitioner, namely, Ram Babu Rai is directed to be released on bail on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VII, Saran at Chapra in connection with Sonepur P.S. Case No. 167 of 2002 (Tr. No. 883 of 2016) subject to the condition that the petitioner shall remain present on each and every date during the course of the trial in the court below. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
