JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 14.07.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner apprehends his arrest in connection with Chapra Mufassil P. S. case no. 69/2015 registered under sections 457 and 380 of the Indian Penal Code.

Petitioner is named in the first information report but admittedly, neither informant nor any prosecution witness claimed to have seen the petitioner committing theft in the house of the informant.

So far as criminal antecedent of the petitioner is concerned, it has specifically been mentioned at para 9 of the petition that he has already been acquitted in Bhagwan Bazar P. S. case no. 52/2011 and Morhowrah P. S. case no. 74/2011.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed

Patna High Court Cr.Misc. No.24905 of 2015 (2) dt.14-07-2015 and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Chapra Mufassil P. S. case no. 69/2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
