JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 356, 379, 395, 120(B), 34 of the Indian Penal Code.

The prosecution case as per F.I.R is that the informant was intercepted by three persons riding on a motorcycle and they snatched the bag from the informant containing Rs. 4,70,000/-.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely

The petitioner is not named in the F.I.R and only on the basis of suspicion, the petitioner has been roped in the present case. The petitioner has not been put on T.I.P till date. Nothing has been recovered from the possession of the petitioner. Moreover, other similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 51678 of 2022. The petitioner is languishing in custody since 19.04.2022.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Sakri P.S. Case No. 60 of 2022.
