Heard the learned counsel for the petitioners and learned APP for the State.
The petitioners apprehend their arrest for the offences alleged under Sections 365 and 34 of the Indian Penal Code, registered in connection with Chakiya P.S.Case No. 251 of 2020.
As per allegation, at the mediation of the son of the
Patna High Court CR. MISC. No.62770 of 2021(5) dt.03-01-2023 2/3 informant, the accused persons credited some money to Subodh Kumar. The accused persons, including the petitioners, came to the house of the informant and they demanded money from the son of the informant which was credited to Subodh Kumar at the instance of the son of the informant. They took away his son Pappu Kumar.
The learned counsel for the petitioners has submitted that the FIR itself shows that the son of the informant was the mediator and on his assurance the money was credited to Subodh Kumar. He has also submitted that the entire money has been refunded and both the parties have compromised the case. Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Motihari, East Champaran in connection with Chakiya P.S.Case No. 251 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided
