Petitioner being the husband of the informant is languishing in custody since 19.07.2016 in a case registered for the offences punishable under Sections 498A, 323, 341, 504/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The prosecution case is of inflicting torture after four years of marriage and birth of two children, making assault and due to assault pregnancy got terminated. It is submitted by the learned counsel for the petitioner that petitioner admits his marriage with the informant.
The petitioner was granted provisional anticipatory bail on the undertaking that the petitioner is ready to keep the complainant with full dignity and honour, but the petitioner failed to comply the undertaking.
Patna High Court Cr.Misc. No.37838 of 2016 (2) dt.30-08-2016 Consequently the learned court below has cancel the bail bonds of the petitioner. It is further submitted that petitioner made an attempt to get the issue reconcile, but the issue could not be reconciled due to apathetic attitude of the informant.
Considering the nature of accusation, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Nawada in connection with Nawada Mahila P.S. Case No. 41 of 2014. (Dinesh Kumar Singh, J) P.K./- U T
