The petitioner seeks bail in a case instituted for the offences under Sections 406 and 420 of the Indian Penal Code. The prosecution case in short is that the accused person committed theft of the truck of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.12.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The alleged occurrence is said to have taken place on 26.11.2018 but the case was instituted on 2.12.2018. The delay in lodging the case has not been explained. There was a dispute in respect to the wage. The petitioner

Patna High Court CR. MISC. No.48409 of 2019(2) dt.06-08-2019 2/2 happens to be driver of the tractor. There was a dispute between the petitioner and the informant, hence, the present case has been instituted. The tractor in question has already been recovered.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Purnahiya P.S. Case No. 127/2018.
