JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner wants to renew his prayer for bail, which was earlier rejected vide order dated 17.03.2016 passed in Cri. Misc. No. 2765 of 2016, on the ground that the petitioner is suffering in custody since 20.04.2015, there is no eye witness of the occurrence, post mortem report does not corroborate the prosecution version and up till now not even a single prosecution witness has been examined and as such in near future the trial is not likely to be concluded to which the learned A.P.P. opposes by submitting that from the house of the petitioner the dead body of the deceased was recovered and the petitioner has called him to take back the amount of Rs. 2,00,000/-.

In the facts and circumstances stated above, finding

Patna High Court Cr.Misc. No.44990 of 2016 (2) dt.19-10-2016 2/2 no good ground for reconsideration of prayer of bail, again prayer of bail of the petitioner stands rejected.

However, considering the period of detention of the petitioner the learned trial court is directed to expedite the trial and conclude the same as early as possible, preferably within six months from the date of receipt/production of a copy of this order, failing which the petitioner, if at no fault, may renew his prayer of bail.
