The petitioner apprehends his arrest in a case registered under section 498A of the Indian Penal Code and 3⁄4 of the D.P. Act. The allegation made by the informant in the F.I.R. is that her marriage was solemnized with Sanjiv Kumar @ Nilam @ Mantoo in the year 2008 and her parents gave dowry under his capacity at the time of her marriage. It is alleged that the after marriage she was kept well by the accused persons for one year. It is also alleged that after one year the accused persons began to demand one lac rupees and one motorcycle. On refusal the accused persons assaulted and tortured her for non-fulfillment of demand.
It has been submitted on behalf of the petitioner that petitioner is ready to keep is wife with all dignity but the same is not acceptable to her. It has further been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.25480 of 2015 (2) dt.14-07-2015 2/2 petitioner that petitioner is ready to deposit Rs1500/- per month in the court below which shall be released in favour of the informant.. On behalf of the State it is submitted that petitioner is named in the first information report.
Considering the aforesaid facts the petitioner is directed to deposit Rs. 1500/-/- per month in the court below which shall be released in favour of the complainant and thereafter, the above named petitioner in the vent of his arrest or surrender before the court below within a period of four weeks from the date of receipt /production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri A.K. Rai, J.M. Ist Class, Patnacity in Khushroopur P.S. Case No. 168 of 2014. , subject to the conditions as laid down under section 438(2) Cr.P.C. (Sudhir Singh, J) M.Rahman/- U T
