JUSTICE BIRENDRA KUMAR ORAL ORDER 09-04-2019 Heard learned counsel for the petitioner learned counsel for the informant and learned APP for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 406, 407, 504, 506 and 34 of the Indian Penal Code.
Petitioner is proprietor of the Rice Mill. Allegation is of misappropriation of the cost of rice.
Submission of learned counsel for the petitioner is that petitioner was granted provisional bail in this matter by order dated 20.12.2017 as the petitioner was ready for amicable settlement. Further submission is that a settlement has reached with the bank whereunder the petitioner has to pay total 11.5 Crores to the bank. Out of that Rs. 90,00,000/- have already been paid to the bank after selling out a part of the mortgaged
Patna High Court CR. MISC. No.61026 of 2017(10) dt.09-04-2019 2/2 property. No money of the sale proceed was utilized by the petitioner rather entire money went to the said bank. In due course the petitioner would clear the remaining dues. Learned counsel for the informant opposed the prayer for bail.
Considering the aforesaid facts, let the provisional bail granted to the petitioner be confirmed with condition that if the petitioner would fail to pay the dues that would give rise to cancellation of bail bond by the court itself. (Birendra Kumar, J) vinita/- U T
