JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 363 and 365 of the Indian Penal Code. The prosecution case, in brief, is that one Ranjan Kumar gave a written report addressing to the Officer Incharge of Sulgtanganj Police Station stating therein that Rupesh Kumar is his brother- in-law. On 29.8.2014 he received information by one Rail employee that his brother -in-law Rupesh Kumar in the night went at Khariya Pipra for discharging his duty but he was traceless since 10 P.M. in the night and some one has kidnapped him and his all articles except motor cycle were available. It is submitted on behalf of the petitioner that the petitioner is in custody since 11.12.2015. Charge sheet has been

The petitioner is not named in the FIR. The victim is said to have been recovered on the very next day. The victim has not named he petitioner. The name of the petitioner has come in the confessional statement of co-accused. On behalf of the State, it is submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th A.D.J., Bhagalpur in connection with Sultanganj P.S.Case No. 190 of 2014 (S.T.No. 290 of 2016 ( c ).
