JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2019 This application, for grant of anticipatory bail, arises out of Khajekala P.S. Case No. 319/18, disclosing offences under Sections 302/34 of the Indian Penal Code. Prosecution case is that brother of informant was shot dead by unknown persons. Petitioner was initially not named in the F.I.R. later on his name transpired during investigation on confession of co-accused.

Submission of learned counsel for the petitioner is that he has been made accused in this case only on the basis of suspicion and except that there is nothing against the petitioner Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail of the petitioner on the ground that the statement of co-accused Vicky Kumar disclosed the active involvement of the petitioner in the offence.

No.48759 of 2019(3) dt.16-11-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner has to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
