JUSTICE KUMAR MANISH ORAL ORDER 29-07-2026 Heard learned counsel for the petitioner, Mr. Abhishek Kumar assisted by Mr. Hemant Ray along with Mr. Tarkeshwar Nath Thakur, learned A.P.P. for the State.

2. This application is filed for grant of regular bail to the petitioner who has been made accused in connection with Dumariyaghat P.S Case No. 184 of 2026 instituted for the offence punishable under Sections 30(a), 41(1) of the Bihar Prohibition and Excise Act, 2016 (as amended up-to-date).

3. As per the prosecution, during the course of patrolling, there was a recovery of 198 liters of country-made liquor from the Alto car bearing Registration No.- BR06Y4102.

4. Learned counsel for the petitioner submits that the

No.51607 of 2026(2) dt.29-07-2026 2/3 petitioner is innocent and he has been falsely implicated in this case and has committed no offence as alleged against him, and that he is simply a victim of false allegation only on the basis of suspicion. It has further been submitted that nothing has been recovered from the conscious possession of the petitioner.

5. It has been submitted that the petitioner is neither the driver nor the owner of the vehicle. Also, he has no concern with the alleged liquor and vehicle.

6. Learned counsel for the petitioner submits that the petitioner is in custody since 09.06.2026 and is having a clean antecedent.

7. Considering the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No- 3, East Champaran, Motihari in connection with Dumariyaghat P.S Case No. 184 of 2026, subject to following conditions:- (i) One of the bailors should be family member of the petitioner.

(ii) Petitioner will co-operate in the trial and will remain present on all dates personally or should be duly

(iii) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
