====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-10-2018 Heard learned counsels for the petitioner and the State.

Petitioner seeks bail in connection with Rajgir P.S. Case No. 157 of 2018 registered for the offence punishable under section 395 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that merely on confessional statement of co-accused, Petitioner has falsely been implicated in this case. Petitioner is neither named in the F.I.R. nor any incriminating articles has been recovered from the conscious possession of the petitioner. Moreover, similarly situated co-accused has been granted bail by a Co-ordinate Bench of this Court vide order dated 06.10.2018 passed in Criminal Misc. No. 60315 of 2018. Petitioner has no criminal antecedent and is in custody since 12.07.2018.

No.61097 of 2018(2) dt.08-10-2018 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 157 of 2018.
