JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-392, 411 & 414 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, allegedly, the looted mobile was kept on surveillance and on that basis, it was detected that the petitioner was using looted mobile and thereafter, he was apprehended and the looted mobile is said to have been recovered from his possession.
Submission on behalf of petitioner is that the petitioner has been implicated in this case by the police and as a matter of fact, nothing had been recovered from conscious possession of the
Patna High Court Cr.Misc. No.37440 of 2016 (2) dt.08-09-2016 2/2 petitioner. It is further submitted that moreover, the petitioner is in jail custody since 06-07-2016 but uptill now, he has not been put on TIP.
No doubt, the petitioner carries criminal antecedent of some cases but considering the above-said facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bihiya P.S. Case No. 42 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara. (Hemant Kumar Srivastava, J) A.K.V./- U T
