The petitioner seeks bail in a case registered for offences under Section 379/411 of the Indian Penal Code. It is contended that, as per allegation, the petitioner pick pocketed the purse of one person who was coming out of a jewellery shop after selling his ornaments. He was apprehended by the guard and Rs. 500/- and a blade was recovered from his pocket.

It is contended that he has been falsely implicated for the reason that he was demanding his emoluments as he was

It is further contended that the purse was not recovered from the possession and after selling the jewellery it will not be possible that only Rs.500/- would be in the said purse. It is also not stated anywhere that ATM Card which was recovered from the pocket belongs to some other person. It has been stated in paragraph 3 that the petitioner is having clean antecedent and he is in custody since 27.04.2018.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M, Jhanjharpur, DistrictMadhubani in connection with Ghoghardiha P.S. Case No. 38 of 2018, G.R. No. 489 of 2018 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
