The petitioner seeks bail in a case registered for offences under Sections 356/379 of the Indian Penal Code. It is contended that, as per the allegation, two persons came on motorcycle and snatched a bag full of cash amounting to Rs. 1,50,000/- which was withdrawn from the State Bank of India by the informant.
It is contended on behalf of the petitioner that he has been implicated in this case only on the basis of confessional statement of co-accused Ajit Yadav who has stated that Rahul
Patna High Court Cr.Misc. No.62778 of 2018(2) dt.08-10-2018 2/2 Yadav had snatched the bag and on the basis of his confessional statement the said amount was recovered from Rahul Yadav, however, no incriminating material has been recovered from the possession of the petitioner. The petitioner has also not been put on Test Identification Parade. It is further contended that the petitioner is in custody since 30.07.2018 merely on the basis of confessional statement of the co-accused.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara-Nawada P.S.
