JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-07-2015 Heard learned counsels for the petitioners and the State. The petitioners being brother and brother's wife of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 323,504,498A,341,304B and 363 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.

The accusation is of killing the daughter of the informant after about ten years of marriage. The specific accusations of making assault, confining the victim in a room and driving her out from the matrimonial house are against the husband of the victim. It is further alleged that the husband of the victim came to the house of the informant and forcibly took away

Patna High Court Cr.Misc. No.25406 of 2015 (3) dt.29-07-2015 2/2 both the children of the victim and gave threatening to the informant and thereafter the victim died on 3.12.2014. It is submitted by the learned counsel for the petitioners that the petitioners are separate from the husband of the victim and the documents on record suggest that the victim was being treated at Jawahar Lal Nehru Medical College Hospital, Bhagalpur and during the course of treatment she died on 3.12.2014. Considering the thrust of accusation against the husband of the victim, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Munger in connection with Kasim Bazar P.S. Case No. 9 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
