JUSTICE SUDHIR SINGH ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 394 of the Indian Penal Code and later on Section 396 of the Indian Penal Code has been added.

Prosecution case, in brief, is that while informant's husband was going to deposit Rs.16,87, 320/- in the bank after withdrawing the same from LIC office, some unknown miscreants fired shot at him and fled away taking the money. It has been submitted on behalf of the petitioner that he is in custody since 20.5.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is not named in the F.I.R. There is no recovery of any incriminating article from the possession of the petitioner. Petitioner has not been put on T.I.P. The name of the petitioner has come in this case merely as the Supervision Officer suspects hand of this petitioner. Except for that there is no other substantive evidence to indicate petitioner's involvement in the present case.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Phulwaria P.S. Case no. 94 of 2016.
