JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-10-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 307/34 of Indian Penal Code and Section 27 of Arms Act.

As per FIR, petitioner caused fire arms injury on the chest of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. During the course of investigation, it has come that actually it was one co-accused namely Ratneshwar Kumar who fired the pistol from which the informant sustained injury. Petitioner has no criminal antecedent.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.62623 of 2021(4) dt.10-10-2022 2/2 bail stating that there is specific allegation against the petitioner that he caused fire arms injury on the chest of the informant. Considering the aforesaid facts, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
