Petitioner apprehends his arrest in connection with Patory P. S. case no. 113/2014 registered under sections 406, 409, 467, 468 and 471 of the Indian Penal Code.

Petitioner was employee of the Punjab National Bank and it is alleged that he credited Rs 1 lakh 80 thousand in the account of his son. Subsequently, the aforesaid amount was withdrawn by the son of petitioner.

The contention on behalf of the petitioner is that petitioner has already deposited Rs 1 lakh 80 thousand with the concerned bank. It is submitted that the petitioner has been implicated in this case due to rivalry of the union and, as a matter of fact, some one did the aforesaid act and moreover, at best, it may be a case of temporary embezzlement.

Patna High Court Cr.Misc. No.24888 of 2015 (2) dt.17-07-2015 Accordingly, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in Patory P. S. case no. 113/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
