JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor.

The application is for grant of bail in connection with Marauna PS case no. 87 of 2016 for the offence under Sections 366(A)/34 of the Indian Penal Code.

It is submitted on behalf of petitioner that petitioner is named in FIR. It is further submitted that petitioner along with other conspired and enticed away the daughter of the informant but in the statement of victim recorded under Section 164 of Code of Criminal Procedure, she has clearly stated that as her father was ready to marry her with some other persons and she is in love with other, she had fled away on her own will and her statement on S.A is also to that effect. It is further submitted that

Having heard both sides. In view of the statement of victim recorded under Section 164 of Code of Criminal Procedure and that petitioner is in custody for more than three months, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Marauna P.S. case no. 87 of 2016 with a condition that bailors should have the property within the jurisdiction of learned court below.
