The petitioner seeks bail in Brahampura P.S. case No. 214 of 2015 registered under Sections 419, 420, 406, 467, 468, 471, 323, 504 and 120(B) of the Indian Penal Code. The informant alleged that he along with his family members and staff altogether invested Rs. 51,12,720/- in the company of the petitioner but the petitioner did not return the amount after maturity.
The learned counsel for the petitioner submits that the petitioner has been granted bail in four other cases on condition that the petitioner would deposit the security money either in form of fixed deposit or documents of immovable property as security. It is further submitted that the wife of the petitioner is suffering from cancer. The petitioner was granted
Patna High Court Cr.Misc. No.51064 of 2017 (7) dt.11-07-2018 2/2 provisional bail. The petitioner is ready to deposit the documents of the immovable property worth Rs. 51,12,720/- as security and papers of fixed deposit of Rs. 20 lacs within four months from the date of his release.
Having considered the facts aforesaid and the undertaking given by the petitioner and the fact that petitioner is in jail for about two years, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateXII, Muzaffarpur, in connection with Brahampura P.S. case No. 214 of 2015 subject to condition that one of the bailors shall be close relative of the petitioner having immovable property and the petitioner shall deposit documents of immovable property of Rs. 51,12,720/- and papers of fixed deposit of Rs. 20 lacs standing in his name within four months from the date of his release failing which the learned Court below shall cancel the bail bonds of the petitioner forthwith after lapse of four months.
