====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 11-08-2025 Heard learned counsel appearing on behalf of the petitioner and learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Complaint Case No. 57C of 2022 registered for the offence punishable under Sections 323, 324, 379, 504, 506, 354, 419, 420, 379, 376 and 493 of the Indian Penal Code.

3. As per the allegation made in the F.I.R., the petitioner is said to have cheated the complainant and also established physical relationship with her on the pretext of providing job.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and he has

He further submitted that both the petitioner and the complainant are major and they are already married and they have accepted that they were in relationship and established physical relationship.

Learned counsel appearing on behalf of the informant opposed the prayer for grant of pre-arrest bail to the petitioner submitting that processes under Section 82 and 83 Cr.P.C. have been issued against the petitioner. Learned APP has also supported the argument advanced on behalf of the informant.

Considering the nature of allegation made against the petitioner, as well as, the acceptance of the complainant who is already married that she was in relationship with the petitioner, any act in which the complainant has indulged, she can understand the significance and the consequences of the moral or immoral quality of act she was consenting to, as has been laid down by the Apex Court in the case of Naim Ahmed Vs. State (NCT of Delhi), reported in (2023) 15 SCC 385, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the

Patna High Court CR. MISC. No.50633 of 2025(2) dt.11-08-2025 3/3 like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Khagaria in connection with Complaint Case No. 57C of 2022, subject to the condition as laid down under Section 438(2) Cr.P.C / 482(2) BNSS.

7. The District Court is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in some other cases as what has been stated in Para3 of the bail petition, this order will automatically lose its force.

8. The bail application stands disposed of.
