Petitioner, who is in custody, seeks bail in connection with G.R.P. Samastipur P.S. Case No. 27 of 2018 registered for the offences punishable under Sections 304(B), 120(B) and 34 of the Indian Penal Code.

Informant who is the mother of the deceased has alleged that when she along with her daughter (deceased) were travelling in train, petitioner (husband) along with other coaccused threw her daughter near the railway track at outer signal from Samastipur station due to non-fulfillment of demand of dowry. Informant saw petitioner fleeing away. It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.67079 of 2018(3) dt.06-11-2018 2/2 that he is innocent and has committed no offence. He has been falsely implicated in this case. He is the husband of the deceased. Allegation of demand of dowry is false and concocted. His wife (deceased) was suffering from mental illness and tried to commit suicide in course of travelling from train she fell down and later on she died in course of treatment. He has no criminal antecedent. He is in custody since 23.04.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rail, Samastipur in connection with G.R.P.
