Mr. Sunil Kumar, AC to GA-12 ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-08-2019 The grievance of the petitioners in the present writ petition is non-payment of salary.
Learned counsel for the petitioners submits that the petitioners were legally and validly appointed and they are regularly working, but salary has been stopped. The issue of payment of remuneration requires factual enquiry. Accordingly, the writ application is disposed of with a direction to the respondent District Programme Officer (Establishment), Nawada to enquire about the validity of the services of the petitioners and ascertain whether they have worked as Panchayat Teacher or not for the period they are claiming salary.
In case, if it is found that the petitioners have worked for the period they are claiming salary, the respondent District Programme Officer (Establishment), Nawada shall ensure payment of salary for the period the petitioners have actually worked.
Necessary decision in this regard must be taken by the
Patna High Court CWJC No.16150 of 2019(2) dt.08-08-2019 3/3 respondent District Programme Officer (Establishment), Nawada at the earliest preferably within a maximum period of 60 days from the date of receipt/production of a copy of this order.
With the aforesaid, the writ petition stands disposed of.
