JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 379 of the Indian Penal Code.
Allegation is with regard to theft of Bolero vehicle of the informant which was registered in the name of his wife, namely, Krishna Devi.
It has been submitted on behalf of the petitioner that he is in custody since 1.12.2015. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. He is not named in the F.I.R. The allegation is that he was found traveling in a theft vehicle. Petitioner had no knowledge regarding the vehicle being a stolen one. He has not been put on T.I.P. to ascertain his involvement in the present case. Other co-accused has been granted bail vide Cr Misc. no. 23587 of 2016.
On behalf of the State, it is submitted that petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond
Patna High Court Cr.Misc. No.26182 of 2016 (3) dt.18-08-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Kazimohammadpur P.S. Case no. 157 of 2015.
