JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Belaganj P.S. Case No. 31 of 2015 for the offences instituted under Sections 341, 147, 148, 149, 307, 504 of the IPC and 27 of the Arms Act.
The prosecution story, in brief, is that the petitioner and others are said to have indulged into opening of indiscriminate firing aiming at the informant and others. It is alleged that in course of such occurrence while fleeing away the informant immediately informed the police who reached there and after chase arrested two of the accused Mukesh Kumar and Upendra
Patna High Court Cr.Misc. No.26485 of 2015 (3) dt.23-09-2015 2/2 Singh with rifle and cartridges.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is case and counter case. It is further submitted that no injury is said to have been caused by the petitioner.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Belaganj P.S. Case No. 31/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
