The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 307, 379, 34 of the Indian Penal Code.
As per the prosecution case, petitioners alongwith some unknown persons assaulted the informant and his brothers by iron rod and knife, as a result of which, they sustained injury. It is further alleged that when mother of the informant came to rescue them, she was also brutally assaulted by the accused persons and thereafter, the co-accused Sunil Kumar took away Rs. 20,000/- from the shop of the informant.
It is submitted on behalf of petitioners that there is
Patna High Court CR. MISC. No.62768 of 2021(2) dt.11-07-2022 2/2 case and counter case and both sides sustained injury. The injury has been found to be simple in nature. Similarly situated coaccused Subhash Rai and Sunil Kumar have been granted anticipatory bail, vide order dated 20.06.2022 passed in Cr. Misc. No. 59985 of 2021. Petitioners have got clean antecedent. Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Danapur (Patna) in connection with Rupaspur P.S. Case No. 348 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
