Patna High Court CWJC No.374 of 2015 dt.13-01-2016 2/2 Learned counsel for the State raises a preliminary objection and submits that the dispute for which the petitioner has approached the High Court is amenable to arbitration before the Bihar Public Works Contracts Disputes Tribunal (hereinafter referred to as the 'Tribunal').

In view of the aforesaid, learned counsel for the petitioner seeks permission to withdraw the writ petition in order to enable him to file an appropriate case before the Tribunal and raise all the points available to him including those in the present writ application.

Accordingly, as prayed for by learned counsel for the petitioner, the writ petition stands disposed off as withdrawn with the liberty aforesaid. The Tribunal shall, after hearing the parties, pass orders without being prejudiced by the present order. (Ahsanuddin Amanullah, J) Anjani/- U
