The petitioner apprehends his arrest in a case under Section 384 and other sections of the Indian Penal Code. The petitioner is alleged to have intercepted the informant and snatched Rs. 40,000/- from his pocket after assaulting him. The petitioner also demanded Rs. 1,00,000/- from the informant.
From perusal of the F.I.R. itself, it appears that the informant admitted that here is a land dispute between the informant and the petitioner. The brother of the petitioner is said to have kidnapped the cousin grand-father of the informant and got a power of attorney executed. It is submitted that prior to lodging of this case, the petitioner lodged Hajipur Sadar P.S. Case No. 449 of 2014 against the family members of the informant and,
Patna High Court Cr.Misc. No.26649 of 2015 (2) dt.17-07-2015 2/2 that is why, this case has been filed on 10.10.2014 after 20 days of the case instituted from the side of the petitioner. Considering the fact that the petitioner and the informant belong to the same family although the parties are on litigating terms, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hazipur in Hazipur Sadar P.S. Case No. 482/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
