Petitioner seeks bail in Salimpur P.S. Case No.198 of 2018 instituted for the offence under Section(s) 414 Indian Penal Code.

Counsel for petitioner submits that petitioner has been arrested merely on suspicion. The motorcycle, which is alleged to have been recovered from possession of the petitioner, was purchased by him from Anil Kumar, which fact has also come in the impugned order.

The police mentioned in the written report that on confidential information the police went to the house of the petitioner and seized the motorcycle, which is alleged to be

Counsel for the petitioner further submits that petitioner is handicapped. He has annexed report of the Medical Board, which is annexed as Annexure-2, which shows that he is 75% handicapped of both legs suffering from polio. He is in custody since 23.07.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, III, Barh, in connection with Salimpur P.S. Case No.198 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
