JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 467, 406, 460, 420, 120(B) and 471 of the Indian Penal Code.

The allegation against the petitioner is that he along with other accused with a dishonest intention took huge amount from the complainant on the pretext of providing job on compassionate ground but later on by creating some forged papers grabbed her land.

It has been submitted on behalf of the petitioner that no money was received by the petitioner. There is no transaction between the petitioner and the complainant. The

Patna High Court Cr.Misc. No.25944 of 2015 (3) dt.23-09-2015 2/2 transaction was between the complainant and Lalit Singh. The only allegation against the petitioner is that he also accompanied the said Lalit Singh.

On behalf of the State and counsel for the complainant, it has been submitted that by way of fraud they have grabbed the land of the complainant.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Subhash Kumar Roy, learned J.M., 1st Class, Muzaffarpur in connection with Tr. No. 4223 of 2014 arising out of Complaint Case No. 2988 of 2009, subject to the conditions as laid down u/s 438(2) Cr.P.C. (Sudhir Singh, J) singh/- U T
