JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being the son of the informant apprehends arrest in a case registered under sections 379, 387, 504 and 506/34 of the Indian Penal Code.

It is alleged that the petitioner forcibly loaded 20 quintals wheat and 2 quintals mustard on a tractor from the house of the informant and abused him. The petitioner also threatened the informant for executing sale deed of the land of his share in favour of the petitioner. The petitioner also took away Rs.550/- from the pocket of the informant.

It is submitted by the learned counsel for the petitioner that due to demand of his share in the ancestral property, the petitioner has been made accused. The statement to this effect has

Considering the nature of the accusation, and informant and petitioner being father and son , let the petitioner be released on anticipatory bail on deposit of Rs.11,000/-(eleven thousand)before the learned court below, which will be released in favour of the informant, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Shamho P.S. Case No.27 of 2013, subject to the conditions as laid down under section 438(2) Cr.P.C.

The bail bond of the petitioner shall be accepted on filing affidavit that petitioner will not misbehave with the informant and any misbehaviour reported to the police station will give liberty to the learned court below to cancel the bail bond of the petitioner.
