JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365/34 of the Indian Penal Code.

Petitioner was in live-in-relationship with husband of the informant since last ten years but on 02.07.2015, the husband of the informant was found missing and thereafter, informant lodged the present case. In course of investigation, it came to light that petitioner had developed her sweet relation with one Pankaj Kumar and, thereafter, aforesaid Pankaj Kumar was arrested and disclosed before the police that he as well as petitioner pushed the informant's husband from a running train. The petitioner was, too,

Patna High Court Cr.Misc. No.38784 of 2016 (3) dt.15-11-2016 2/2 arrested and she made her confessional statement accepting her guilt. It appears that except the aforesaid confessional statements, there is nothing against the petitioner. The investigation against the petitioner has already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Muzaffarpur in connection with Sakra P.S.
