Grievance of the petitioner is only with regard to non payment of G.P.F. for a period of four years. However, in the entire pleadings of the writ petition, no details with regard to the said four years period has been mentioned; on the other hand in the counter affidavit filed on behalf of respondent no. 7, a categorical stand is that the petitioner has already been paid the entire G.P.F. amount in the year 2009 itself.
In view of the vague averment in the writ petition, without actual period for which G.P.F. amount has not been paid and
Patna High Court CWJC No.5066 of 2012 dt.04-07-2016 also there being a categorical stand on affidavit in the counter affidavit that the same has been paid in the year 2009, the Court is not in a position to pass any order on merits.
Accordingly, in view of the statements made in the counter affidavit on oath by a public servant, the Court having no reason to disbelieve the same, the writ petition stands disposed off. (Ahsanuddin Amanullah, J) Amin/- U
